Reply to the application of defendant under order 6 rule
2 r/w order 8 rule 2 filed by counsel for plaintiff. Copy supplied.
Heard arguments on the said application.
It is submitted by counsel for defendant that plaintiff has
incorporated some new facts in para 8 of the affidavit. It is
submitted that the said facts are not part of the plaint.
It is submitted by counsel for the plaintiff that the
defendant has now sold the suit property to some third person and
he in para 8 of the affidavit has incorporated the subsequent facts.
It is submitted that the said fact came to the knowledge of the
plaintiff after filing of the plaint. Hence, the same is mentioned in
para 8 of the affidavit.
When the court question was put to the defendant and
his counsel as to whether the defendant has sold the suit property,
the defendant admitted to that he has sold the suit property to some
third person.

The plaintiff by virtue of the para 8 of the affidavit wants
to incorporate the subsequent facts regarding sale of the suit
property by the defendant. The present suit is for recovery of the
bayana amount.
Accordingly, the application of the defendant is
dismissed.
