Perusal of report shows that one application on
behalf of defendant no. 2 was filed online for setting aside ex-
party order passed on 26.04.2025 against the defendant no. 2.
Ld. Counsel for defendant no. 1 submitted that above
application was wrongly filed against defendant no. 2 instead of
defendant no. 1. Ld. Counsel for defendant no. 1 submitted that
she is also representing defendant no. 2 however vakalatnama is
not filed.
Considering the submissions, above application for
setting aside ex-party order qua defendant no. 2 stands dismissed
as requested by Ld. Counsel for defendant no. 1 as wrongly filed.
Ld. Counsel for defendant no. 1 further submitted
that defendant no. 1 will file fresh application and seeks
adjournment for file the same.
Today, matter is listed for PE. Evidence by way of
affidavit on behalf of PW-1 alongwith list of witness is filed
online. Hard copy is placed on file. Advance copy supplied to
opposite party.
In the interest of justice matter is adjourned subject
to cost of Rs. 2,000/- to be paid by defendant no. 1 to plaintiff for
seeking adjournment for filing fresh application for setting aside

setting aside ex-party order dated 26.04.2025 as
