The present transfer petition is filed u/s. 448 of BNSS,
2023 seeking transfer of Criminal Appeal bearing no. 311/2025
titled as “Siddharth Khanna vs. State”, which is stated to be pending
before the Court of Ld. Additional Sessions Judge-05, North-West,
Rohini Courts, Delhi.
It is further submitted by Ld. Counsel for the petitioner
that there were two accused namely Siddharth Khanna and Manish
Ratawal in the same FIR No.733/2014, PS Keshav Puram and both
got convicted vide impugned judgment dated 01.09.2025 and order
of sentence dated 22.09.2025 passed in Case No. 0541851/2026 by
the Ld. JMFC(Mahila Court)-02, North-West, Rohini Courts, Delhi.
He further submits that both the convicts filed separate appeals,
Criminal Appeal bearing no. 311 of 2025 filed by Siddharth
Khanna, was assigned to the Court of Ld. ASJ-02, North-West,
Rohini Courts, Delhi, and Criminal Appeal bearing no. 275 of 2025
filed by Manish Ratawal, was marked to the Court of Ld. ASJ-05,
North-West, Rohini Courts, Delhi.

Ld. Counsel for the petitioner seeks transfer of Criminal
Appeal bearing no. 275 of 2025 filed by Manish Ratawal, from the
Court of Ld. ASJ-05, North-West, Rohini Courts, Delhi to the Court
of Ld. ASJ-02, North-West, Rohini Courts, Delhi, so that the
appeals regarding both the accused persons pertaining to the same
offence and same FIR can be listed in the same Court.
Heard. Record perused.
In view of the submissions made, the present transfer
petition is allowed. The criminal appeal bearing no. 275/2025 filed
by accused Manish Ratawal pending before the Court of Mr. Sachin
Mittal, Ld. ASJ-05, North West District, Rohini Courts, Delhi, and
is transferred to the court of Mr. Shivaji Anand, Ld. ASJ-02, North-
West District, Rohini Courts, Delhi, for disposal as per law, where
the same shall be taken up on 21.07.2026.
Ahlmad of the Transferor Court is directed to send the
case file complete in all respect to the Transferee Court
immediately.
