and 4 with defendant no. 3 and 4.
Vide order dated 04.09.2023, defendants were
granted opportunity to file the written statement till 18.09.2023.
The written statement is filed by defendant no. 3 and 4 on
14.12.2023. No application has been filed showing reasons under
which the written statement could not be filed within time given
nor any application seeking condonation of delay in filing the
written statement is filed.
It is sated by the counsel for the defendant no. 3 and
4 that written statement is supporting the case of the plaintiff and
no objections to the case are filed by the defendant no. 3 and 4.
No written statement is filed on behalf of defendant no. 1 and 2.
The evidence is required to prove that the property whose
partition is being sought by the plaintiff was owned by Sh. Sukh
Dayal Kakkar and Smt. Urmila Devi as such plaintiff to lead
evidence.
