As per record, service has been effected on R1 on mother
of R1 and the said report is dated 19.02.2025. Accordingly,
defence of R1 stands struck off.
Heard and record perused.
On the basis of pleadings of the parties, following issues
are being framed:
1. Whether on 20.06.2024 at about 2.10 am, at Aligarh Palwal
Road, near Gram Pipli, Aligarh, UP, within the jurisdiction of PS
Tappal, District Aligarh, UP, the victim was travelling in an
ambulance bearing registration No. HR-38X-3009 which was
being driven in a rash and negligent manner by its driver/R1
Abhay who had parked the said ambulance on the wrong side and
one unknown truck hit said ambulance and thereby caused death
of victim Achchelal @ Akshay Lal? OPP
2. Whether petitioners are entitled to compensation, if so, to what
amount and from whom? OPP
3. Relief.
Be put up for PE for 27.10.2025.
Petitioner is directed to give advance copy of the affidavit
of witness to respondents one month prior to the next date of
hearing.
Petitioner may also take steps to summon the witness, if so
required, expeditiously.
