Pr: Proxy counsel for petitioner through VC.
R2 in person.
Proxy counsel for insurance company through VC.
R2 has appeared and in proof of service, he has filed self
attested copy of his aadhar card. R2 has also filed WS alongwith
vakalatnama with extra copy for petitioner. It be released to the
petitioner against acknowledgment.
The present matter is connected matter with MACT No.
865/24 titled as Chhotelal vs Abhay. It is stated by Proxy counsel
for R3 that she has received the summons qua present file also
and they will WS in the present matter also. Time sought on
behalf of R3 to file WS. R3 is directed to file WS within a week.
Service report qua R1 and R2 not received back. However,
R2 has appeared today. Petitioner is directed to take steps for
effecting service on R1 on filing of PF/RC and speed post
returnable on next date. Affidavit with tracking report for service
by speed post/RC be filed on the next date. Petitioner is also
directed to get the service effected on R1 in the criminal court
where criminal case is pending. Process be given dasti and proof
of service be filed on the next date.
Petitioner is granted one opportunity to file complete set of
criminal case record.
According to the contents of FIR, accident has taken place
due to rash and negligent driving by the unknown vehicle and as
per contents of FIR, victims were travelling in the ambulance
which has been made the offending vehicle in the present case
and which has been parked on the side of the road due to some
mechanical defect. Therefore, petitioner is directed to make
submissions on the aspect of maintainability on the next date.
Put up for appearance of R1 and consideration of WS of
R3 as well as arguments on maintainability on 28.04.2025.
