An application filed on behalf of plaintiff under Order 6 rule 17 CPC on last date of hearing is pending for disposal. Ld. Counsel for plaintiff stated that inadvertently page 2 of the application has been repeated as page 4 and he is filing the fresh application under Order 6 rule 17 CPC. Same is taken on record. Considering the facts and submissions of Ld. Counsel, application filed today is considered as application for amendment and earlier application under Order 6 rule 17 filed on 13.09.2023 stands dismissed. Submissions on the application under Order 6 rule 17 CPC are heard. By way of present application, plaintiff is furnishing the valuation of the reliefs claimed along with modification in title of the suit and to incorporate some facts about injury to the plaintiff. As the suit is at initial stage and amendment sought are necessary for the appropriate adjudication of the matter, the application stands allowed. Amended plaint filed with the earlier application on 13.09.2023 is taken on file. An application moved on behalf of plaintiff under Order 33 rule 1 CPC for granting exemption from depositing the court fee is also pending.
