Present: Both the appellants are present on bail alongwith Counsel
Mr. S.K. Sengar.
Mr. P. K. Samadhiya, Ld. Chief Public Prosecutor for
the State/respondent.
Arguments addressed.
Ld. Counsel for the appellant submitted that he is praying
for a lenient view on the quantum of sentence. It is stated that the
complainant/injured is the wife of Krishan Murari/appellant no. 1
and mother of Sonu. It is stated that due to some family dispute, she
received hair-line fracture on 18.04.2018 and she did not want any
legal action at that time. However, later on, she pursued the
complaint and on 18.12.2018 lodged a complaint against both the
appellants.
Counsel for the appellants has requested for grant of
probation to the accused persons. It is stated that the complainant is
being paid regular maintenance u/s. 125 HMA to the tune of
Rs.4,000/- per month. It is stated that the complainant is paralyzed
and she is taken care of by their younger daughter namely Ms.Mona
and they are living in the same house but in separate rooms.
