The Ld. counsel for the plaintiff has placed on
record the postal receipt / consignment tracking report, which
shows that the defendant no.2 was also served on 22.04.2026.
It is submitted by the Ld. counsel for the defendant
no.1 that he is not representing defendant no.2.
In view of the above, defendant no.2 (K.K. & Co.) is
proceeded ex-parte. The right of defendant no.2 to file written
statement is closed. Defence of defendant no.2 (K.K. & Co.) is
struck off.
Replication, if any, be filed within stipulated period
with advance copies to be supplied to the other party.
Both the parties are directed to give their proposed
issues along with proposed list of witnesses.
Put up for filing of affidavit of admission/denial of
documents, if any / framing of issues and case management
hearing on 13.10.2026.
