Heard.
Present suit is filed under Order 37 CPC. However, in the opinion
of the court the same is not maintainable under Order 37 CPC as there is no bill,
Hundi or written contract on the basis of which the suit is filed. Hence, the
same is treated to be an ordinary suit for recovery.
Issue summons of the suit for settlement of issues to the defendant
on filing of PF and RC/speed post returnable on next date of hearing. PF be
filed within 07 days from today.
In case of refusal of the summons, the process server is directed to
furnish his affidavit regarding the proof of service or to appear in the court on
the NDOH for recording of his statement. Ahlmad is directed to make the
endorsement on the summons accordingly.
The defendant is directed to file his written statement within 30
days from the date of service of the summons. Endorsement be made on the
