Case file is taken up today on an application filed u/o 5, Rule 20 CPC
seeking service of defendant through substituted means of publication.
Present: Ms. Chitra Malhotra, Ld. Counsel for plaintiff through VC.
The suit stands restored to its original number and position.
An application has been filed u/o 5, Rule 20 CPC on behalf of
plaintiff seeking service of defendant through substituted means by way of
publication in a local news paper having circulation in the concerned/local
area.
Heard. Application perused.
I have also perused the service report qua defendant. Ld.
Counsel for plaintiff/applicant submits that plaintiff is not having any other
address of defendant available with it.
In view of the above, I am satisfied that defendant cannot be
served by way of ordinary process. The present application is accordingly
allowed.
Let defendant be now served by way of publication in news
paper ‘Veer Arjun’ on filing of PF/publication charges. The publication
citation be placed on record on or before the NDOH.
The application stands disposed off in above terms.
List for further consideration now on 28.03.2025.
A copy of this order as well as the process be given dasti to
Ld. Counsel for plaintiff/applicant.
