PRIYANKA Vs. GURMEET KAUR AND ANR
    26.09.2024
Present: Ld. counsel for the plaintiff.
Ms. Iqura Khan, counsel for the defendants.
    Arguments heard.
The matter is still at the initial stage and pertains to
recovery of money and therefore I think that plaintiff would be
more satisfied if delay is compensated in terms of money instead
of closing the rights of defendant to get an adjudication on
merits. 10 days time is granted to file WS subject to a cost of
Rs.10,000/- to be paid by the defendant to the plaintiff. With this
observation, the application of defendant moved under Order 9
Rule 7 CPC is allowed recalling the exparte order.
If the cost is paid and the WS is filed within time, the
plaintiff may file replication whereafter issues will be framed. In
converse situation, if the direction is not complied with by the
defendants, the matter shall be proceeded for exparte evidence
though the defendant shall retain a right to cross-examine the
    plaintiff’s witnesses in that eventuality.
List for further proceedings on 19.02.2025.
