The perusal of the record reveals that the plaintiff has failed to take
steps for service of defendants for the last two dates of hearing. On the last date
of hearing, in the interest of justice, one more opportunity was granted to the
plaintiff. However, the plaintiff has failed to take steps.
In the interest of justice, one more last and final opportunity is
granted to the plaintiff, subject to the cost of Rs.10,000/- to be deposited with
Civil & Sessions Courts Stenographers Association, Delhi Account
No.0613000100079946, IFSC– PUNB0061300, Branch- PNB, Gokhale Market
Delhi.
Let fresh summons for settlement of issues of the Suit be issued
upon the defendant(s), on filing of PF, speed post & requisite Copies and subject
to deposit of cost. Summons to be issued under
Order V Rule 5 CPC 1908 upon
the defendant(s) shall display mandatory endorsement “
defendant should file
Written Statement of defense within 30 days from the date of service/receipt of
summons alongwith Statement of Truth and Affidavit of admission/denial of
