Courts Act 2015, (as amended by Act-2018) is already on record.
Report of compliance reveals that there is deficiency in
the Suit for want of Synopsis of Dates & Events and Declaration
U/O.XI Rule 6(3), which are required as per Commercial Courts Act,
2015. Let the deficiencies be rectified by Ld. Counsel for the plaintiff
within two weeks.
Summons issued upon defendant through ordinary
process received back with the report ‘no such person’. And
summons issued upon defendant through registered cover received
back unserved with the report ‘left’.
At request, let fresh address of defendant be filed.
On compliance, let fresh Summons for settlement of
issues of the Suit be issued upon the defendant(s), on filing of PF, RC
& requisite Copies. Summons to be issued under Order V Rule 5 CPC
1908 upon the defendant(s) shall display mandatory endorsement
“defendant should file Written Statement of defense within 30 days
from the date of service/receipt of summons alongwith Statement of
Truth and Affidavit of admission/denial of documents of the plaintiff”,
as per Commercial Courts Act, 2015.
Steps be taken within two weeks.
