Present: None for plaintiff.
Defendant is unserved.
An application under order V read with Section 151 CPC to
place on record the fresh address of defendant is moved on behalf of
plaintiff.
In view of submissions made in the application, the
application moved on behalf of plaintiff is allowed and amended memo of
parties containing the fresh address of the defendant is taken on record.
An application under order XI Rule 5 CPC for placing on
record the certificate under Section 63(4)(c) of BSA has been moved on
behalf of plaintiff.
The plaintiff by way of present application wants to place on
record the certificate under Section 63(4)(c) of BSA. The matter is at the
initial stage. The defendant is not yet served. Considering the facts and
circumstances of the case, the application under order XI Rule 5 CPC
moved on behalf of plaintiff is allowed and the certificate under Section
63(4)(c) of BSA is taken on record.
Let fresh summons for settlement of issues of the Suit be
issued upon the defendant(s), at the fresh address, on filing of PF, speed
post & requisite Copies. Summons to be issued under
Order V Rule 5 CPC
1908 upon the defendant(s) shall display mandatory endorsement
“
defendant should file Written Statement of defense within 30 days from
the date of service/receipt of summons alongwith Statement of Truth and
Affidavit of admission/denial of documents of the plaintiff”, as per
Commercial Courts Act, 201
5.
Steps be taken within two weeks.
Be put up for report on 15.07.2026.
