Present: Ld.counsel for plaintiff.
Sh. Prem Chandra Sharma & Sh. P.K. Sharma, Ld.
counsel for defendant no. 1 along with defendant no. 1.
Ld. Counsel has filed vakalatnama and submits that he has
not received copy of plaint/document. This is clearly against the
record as the summons shows that defendant no. 1 Mahesh Chandra
has specifically refused to take the summons. Misconduct on the part
of defendant no. 1 in defying the court summons needs to be properly
taken care of so that no person from the public can ever refuse a court
notice/summons. Before however, doing that it would be more
appropriate if Process Server is called so that his statement on oath
can be recorded and it is ascertain as to whether actually this mahesh
chand has refused the summons. Let a notice be issued to the Process
Server.
However, for smooth progress of the suit, the counsel for
plaintiff is directed to give the copy of plaint/document to the counsel
for defendant no. 1 who may file WS within a period of 30 days.
Other defendants have not appeared.
Any of the property of deceased shall be subject to final
outcome of the suit.
