Present: Sh. Akash Deep, Ld. Counsel for plaintiff.
As per report, the plaint is deficient in necessary
compliances.
Perusal of record reveals that in the present case,
plaint has been filed on the basis of orders of the Ld. District
Judge (Commercial Court), North, dated 30.01.2024, wherein the
plaint has been returned on the ground of
territorial jurisdiction
of
North District. Ld. counsel for plaintiff submits that the
address of the defendant no.2 is located within the territorial
jurisdiction of this Court and further submits that the
Non Starter
Report is also issued by
DLSA, North-West District. It is further
perused that an application under Order VII Rule 14 CPC has
been filed on behalf of plaintiff seeking permission to file
additional documents which are not identified so far. The
application is speculative in nature and at this stage, there is no
case made out to give any blanket order. The application is
accordingly disposed of as dismissed.
At this stage, Ld. counsel for plaintiff submits that
the case was at the final stage before the previous Court and
seeks time to obtain the entire case file from the concerned Court

for further progress thereof, as per law. The Court shall
thereafter, examine the submissions, as per law.
In the meanwhile, let notice of presentation of the
Suit of this Court be issued upon the defendants on filing of PF,
RC & requisite Copies.
