Steps not taken.
In the interest of justice, one more opportunity is granted
to the plaintiff to take steps for service of defendant subject to the cost
of Rs.10,000/- to be deposited with DLSA, North West, Rohini, Delhi.
An application under Order V Rule 20 CPC for service
of summons/process to the defendant through substituted services has
been filed on behalf of the plaintiff. It is submitted despite best efforts,
defendant could not be served through ordinary modes of service and
that no other address of the defendant is available with the plaintiff.
Heard. Record perused.
The court is satisfied that defendant could not be served
through ordinary process. Subject to deposit of cost, let the defendant
be served through substituted mode of service by way of publication.
The process be published in newspapers i.e., in one English Daily,
“Statesman” and one vernacular daily i.e.,
“Veer Arjun” having
circulation in the area of the last known address(es) of the defendant
on filing of PF and publication charges. Dasti allowed.
The process shall indicate that the Written Statement to
the Plaint shall be positively filed, within 30 days from the date of
publication of summons. Along with the Written Statement, the
defendant shall also file Statement of Truth and Affidavit of
admission/denial of documents of the plaintiff, without which, the
Written Statement shall not be taken on record. The publication shall
be effected at least 30 days before the date fixed.
Steps be taken within four weeks.
Put up on for report of the publication, appearance of
defendant and further proceedings on 14.10.2026.
