Written statement has been filed online on behalf of
defendant on 04.07.2024. Its replication has been filed online on
31.07.2024.
Pleadings are stated to be complete. From the
submissions and pleadings of the parties, following issues are framed:-
(1) Whether the plaintiff is entitled for recovery of Rs. 25
lacs on account of his malicious prosecution by the defendant as
alleged? OPP
(2) What is the effect of pendency of matter against the
plaintiff in the court of Ld. ASJ, Rohini Court on the present matter?
OPD
(3) Whether the plaintiff is entitled for interest if so at
what rate and for which period? OPP
(4) Relief.
No other issue arises or pressed for. The counsels
appearing for the parties stated that there is no likelihood of the
settlement of matter between the parties at this stage, as such, there is
no use of referring the parties to adopt ADR means. List of witnesses
be filed within 15 days by the parties.
