Present: None.
Arguments have already been heard. Record perused.
The suit was filed by Master Ishan Sharda through his
mother in respect of an immovable property. In the said suit, he had
set up a Will. The suit was however ultimately dismissed vide
judgment dated 10.01.2025 passed in case no. 76417/16.
Now the plaintiff has filed the instant miscellaneous
application for release of the original Will. There is no prohibition
in releasing the original Will. An endorsement however be made on
the original Will that the same has been used in the suit no.
76417/16 and the suit has been dismissed. The office shall make
such endorsement while releasing the original Will after taking
certified copy thereof on record.
With the aforesaid observation, the application is allowed
and disposed of.
Miscellaneous application file be tagged with the main
