An application for substitution of AR has been filed
on behalf of plaintiff bank.
Heard. Perused.
It has been stated in the application that the earlier
AR of the company Sh. Sanjay Kumar, has been transferred to
another branch of the plaintiff bank and the plaintiff bank seeks
permission to substitute the AR namely Ms. Khirabdhitanaya
Mishra, Assistant Manager, in place of Sh. Sanjay Kumar.
Keeping in view the reasons explained in the application,
application is allowed.
Summons issued upon defendant no.1 / Kuldeep
Dabas received back served with the report of process server
dated 10.05.2024.
Ld. Counsel for defendant no.1 prays for supply of

paper book of the plaint. Ld. Counsel for plaintiff undertakes to
provide the same to Ld. Counsel for defendant no.1 within two
days.
On receipt of complete paper book, defendant no.1
shall file written statement alongwith Statement of Truth and
affidavit of admission/denial of documents of the plaintiff, within
four weeks with copy to counsel for plaintiff, who may file
replication within two weeks thereof alongwith affidavit of
admission/denial of documents, if any documents filed by
defendant no.1, with advance copy to be supplied to other side.
As regards the defendant no.2, summons issued
upon defendant no.2 / Narender Singh received back served with
the report of process server dated 05.08.2024. However, none has
filed appearance on behalf of defendant no.2 nor any written
statement has been filed. The maximum extendable period for
filing WS is still available with defendant no.2.
Case to come up for written statement / replication,
if any, / further proceedings on 03.01.2025.
