CENTRAL BANK OF INDIA Vs. SH. PRADEEP CHAND AND ANR.

Present: Sh. Ambuj Maurya, Ld. Counsel for plaintiff.
At this stage, an application seeking substitution of A.R of the
plaintiff bank has been filed stating that the earlier A.R has been transferred
and, therefore, he has been replaced with new A.R namely Ms.
Khirabdhitanaya Mishra, Asstt. Manager. The application is duly
accompanied by the Affidavit of new A.R as well as copy of authority/POA.
Heard.
For the reasons stated in the application, same stands allowed
and the newly appointed A.R is permitted to act in place of the previous
AR.
An application has been filed u/o 5, Rule 20 CPC on behalf of
plaintiff seeking service of defendant through substituted means by way of
publication in a local news paper having circulation in the concerned/local
area.
Heard. Application perused.
I have also perused the service report qua defendant. Ld.
Counsel for plaintiff/applicant submits that plaintiff is not having any other
address of defendant available with it.
In view of the above, I am satisfied that defendant cannot be
served by way of ordinary process. The present application is accordingly
allowed.
Let defendant be now served by way of publication in news
paper ‘
Veer Arjun’ on filing of PF/publication charges. The publication
citation be placed on record on or before the NDOH.
The application stands disposed off in above terms.
List for further consideration now on 23.01.2025.
