The present case has been predicated on ‘Security Agreement’ and
‘Agreement to Sell’ in respect of the suit property. The entire transactions
were towards purchasing the suit property by plaintiff. During the course of
the commercial dealings between the parties, the money seems to have
flowed from plaintiff to the defendant at several intervals of time. It is
apparent that finally the facts culminated into issuance of four cheques by
defendants No.1 & 2 towards discharge of their liability in respect of the
commercial transactions.
The present suit may be considered towards recovery of the
aforesaid cheque amounts. Ld. Counsel for plaintiff wants to obtain fresh
instructions in this regard.
