Present : Sh. Vikas Rathi , Ld. Counsel for the plaintiff.
Sh.Shubham Gupta , Ld.Proxy Counsel for the
defendant no. 1 and 2 (defence already struck off).
None for the defendant no. 3.
Summons were issued to the defendant no. 3 through dasti and
emode. Same could not be served upon the address given as some other person
was found to be residing there. The defendant was informed telephonically.
However, the same is not a proper service. Ld.Counsel for the plaintiff submits
that the defendant no.3 was served through whatsapp also. However, there is no
such report of the Process Server. Screen shot of service through whatsap, if any
be filed on record by the NDOH along with an affidavit.
In the meanwhile, fresh summons be issued to the defendant no. 3
to be served through whatsapp on filing of PF within seven days. Process server is
directed to file the coloured screen shot of the service along with the report. The
said endoresment be made by the Alhmad on the process.
