Written statement alongwith statement of truth, application for condonation of delay, index of documents with documents and vakalatnama filed on record on behalf of defendant. Copy supplied. Ld. Counsel for plaintiff submits that he does not want to file reply to application for condonation of delay and argue on the application straight away. Heard. Admittedly, the written statement is filed within maximum period of 120 days. In view of submissions, the delay is condoned subject to cost of Rs.5000/- to be paid to plaintiff on or before next date of hearing. Replication to written statement be filed within 30 days with advance copy to other party. Further, both parties shall also file their respective affidavit of admission/ denial of documents with advance copy to each other. At this stage, it is jointly submitted that there is likelihood of settlement between the parties and hence request is made to refer the matter to Mediation Centre for settlement. In view of submission, matter is referred to mediation centre for settlement for 23-8-2023 at 02:00 p.m. Parties to appear before Mediation centre accordingly.
