Present: Ms. Jyoti Dwivedi, Ld. Counsel for plaintiff through VC and
Sh.Ankit Dwivedi, Advocate physically present in court.
Sh. Vikas Sharma, Ld. Counsel for defendant along with
Sh.Anil Pathak, AR of defendant in person.
Fresh Vakalatnama has been filed on behalf of the defendant. It
has been endorsed upon the Vakalatnama that complete set of paper book was
received by defendant on 21.03.2025. I have also seen the registered AD envelope
being carried by AR of the defendant which shows service upon the defendant on
21.03.2025.
Today is 121st day after service of the defendant. Till date, the WS
in the matter has not been filed. Therefore, in view of the law laid down by
Hon’ble Supreme Court in ‘MANU/SC/0227/2019’, titled as ‘SCG Contract
India Pvt. Ltd. Vs. K.S. Chamankar Infrastructure Pvt. Ltd. & Ors.’, the
defence of defendant stands struck off. The right of defendant to file WS in
the matter also stands closed.
At this stage, it is jointly stated at bar that there is likelihood
of this matter getting settled between the parties.
Let the matter be placed before Ld. Judge Incharge, Mediation
Center, Rohini Courts on 30.07.2025 at 2.00 P.M. for recording of
settlement, if any, and thereafter before this court on 08.08.2025. Parties are
directed to appear before Ld. Judge Incharge, Mediation Center on the
aforesaid date and time.
