defendant is 9&10. In my opinion, this objection can be decided
only on merit after recording of evidence and cannot be
considered in summary manner that too on the basis of defence
raised by the defendant because under Order 7 Rule 11 CPC we
have to go by plaint averments only. The application is
dismissed. However, the plaintiff shall file a proper site plan of
the property.
Let the parties to file affidavits regarding admission-
