Mr. Mahesh Kumar Sharma, Ld. Counsel for
defendant.
It is stated by counsel for plaintiff that affidavit of
attorney of plaintiff has been filed online on 25.01.2025 but no
affidavit is reflected on CIS.
One application to condone the delay in filing the written
statement as uploaded on 04.11.2024 is reflected on CIS. Perusal of
same reveals that no court fee is paid on the same nor it is signed by
the applicant or counsel nor the affidavit with respect to the application
is signed by applicant and attested by Oath Commissioner/Notary.
Hard copy of affidavit of attorney of plaintiff is placed on
record. Ld. Counsel for plaintiff is advised to approach the Incharge,
Filing Section with respect to non reflection of affidavit on CIS.
It is stated by Ld. Counsel for plaintiff that plaint needs
amendment as grand father of plaintiff has been arrayed as party with
the averments that he is also having right in the property of deceased
father of plaintiff but as per Hindu Succession Act, he is not having
share.
As prayed, put up on 19.03.2025 for further proceedings.
