The defendants have been served with the summons
and vakalatnama is filed on behalf of defendants No. 1 to 3.
None has appeared for defendant No. 4 Nathu Ram
who has been served on 13.04.2024.
The Ld. Counsel appearing for the defendants seeks
time to file WS and reply to the injunction application. The Ld.
Counsel for the plaintiff prays for passing interim orders on the
injunction application.
Considering the facts, the defendants are granted
time to file WS till 13.05.2024 along with reply to the injunction
application. Advance copy be supplied to the counsel for plaintiff
so that replication, if any may be filed.
The defendants are restrained from creating any third
party rights in the ownership of the suit property and defendant
No. 1 is restrained from withdrawing the money from the banks
deposited in the name of deceased Sh. Heera Lal acting as
nominee till the NDOH.
Put up on 24.07.2024 for completion of pleadings,
settlement of issues and arguments on injunction application.
