None for defendant. An application u/o 33 rule 1 CPC filed on behalf of plaintiffs perused. The applicant has filed present application u/o 33 rule 1 CPC seeking permission to institute the suit and indigent person stating that applicants i.e. both plaintiffs does not possess sufficient court fee. Upon perusal of the application along with supporting affidavit court is of view of that for proper adjudication of application, verification of the financial status, moveable and immoveable assets and income applicant in necessarily. Accordingly the concerned SDM of the area where the applicants i.e. both plaintiffs ordinary reside is directed to conduct a detailed inquiry regarding move and immoveable property on or possessed by applicants, source of income, if any, bank accounts or other valuable assets, family assets which may be legally attributable to applicants/ in which applicants have share. The concerned SDM shall verify the fact from revenue reports, local inquiry and any other relevant official report and submitted verification report before NDOH. The report shall specifically mentioned whether the applicant is possessed of sufficient means to pay the court fee for the present suit. Applicants are directed to appear before SDM, if same is required. Matter be listed for filing of report of SDM on 14.05.2026.
