Alongwith the suit, an application u/o 38 rule 5 CPC seeking urgent relief was also moved. In view of fact that urgent relief is sought, compliance of Sec.12 A Commercial Court Act is exempted. Issue summons of the suit and notice of the application to defendant through all modes – on filing of PF/RC through Regd. AD and on filing of e-mail ID of the defendant alongwith soft copy of plaint in PDF format. Affidavit regarding e-mail ID of defendant be also filed. In case of refusal or non-availability, defendant be served by way of affixation for date fixed. Steps to be taken within 15 days. Put up for service on 03.10.2023.
