File taken up today on an application for Early hearing.
Present : Sh. Sidhant Antil, Ld. Counsel for the plaintiff
with plaintiff.
Sh.S.K. Tyagi, Ld. Counsel for the defendant no. 1
and 4 with defendant no. 1.
Notice of this application was issued to all the
defendants. Same has been served on the defendants no. 1 and 2.
Notice issued to the defendant no. 3 not received back. Notice to
the defendant no. 4 received back unserved. However, Ld.
Counsel for the defendant no. 1 and 4 has appeared and filed his
vakalatnama. He submits that he has not received copy of the
plaint and documents. Same be supplied to him under proper
receipt.
It is submitted by Ld. Counsel for the plaintiff that
the defendant n. 4 has initiated construction over the suit
property. Hence, the present application has been filed. Perusal of
the record shows that there is no such prayer on behalf of the
plaintiff regarding construction over the suit property.
At this stage, Ld. Counsel for the plaintiff submits
that the defendants may be restrained from creating any third
party interest in the suit property. Ld. counsel for the defendants
no. 1 and 4 submits that they have no intention to create any third
party interest in the suit property.
As mentioned above, the defendant no. 2 is also
served but he has not appeared. Hence, the defendants no. 1, 2

and 4 are restrained from creating any third party interest in the
suit properties till NDOH.
Put up for 03.06.2023.
Earlier date fixed for 27.05.2023 stands cancelled. In
view of the change of date, fresh summons be issued to the
defendants no. 2 and 3 on filing of PF within seven days for
03.06.2023.
