Matter is at the stage of reply/ arguments on application u/o 7 rule 11
CPC. Matter is also listed for filing of the court fees.
Neither the court fees nor the reply is filed today. Last opportunity
sought on behalf of the plaintiff. Allowed, failing which the matter shall be
dismissed for non prosecution.
Ld. Counsel for the defendant submits that on the last date also, last
and final opportunity was given. Ld. Proxy counsel for the plaintiff submits that the
court fees could not be purchased due to lawyers strike in the last week. However,
Ld. Counsel for the defendant has rightly pointed out that the last date was about 3
months ago and there was sufficient time to take steps. In view of the facts and
circumstances, cost of Rs.3000/- is imposed upon the plaintiff to be paid to the
defendant for non compliance of the order of this court.
Put up for reply/ arguments on 10.07.2025. Advance copy of the same
be supplied to the opposite party atleast 15 days prior to the next date of hearing.
