plaintiff.
Sh. S.K. Tyagi, Ld. Counsel for the defendant no.1,
3 and 4 with defendant no. 1, 3 and 4 in person.
Defendant no. 2 in person.
Fresh vakalatnama filed on behalf of defendant no.3.
Vide sepearate statement recorded of defendant no. 3, she adopts
the WS already filed by the defendant no. 1 and 4.
The defendant no. 2 has appeared. On the last date of
hearing, he was directed to file the WS but the same has not been
filed. In the interest of justice, 10 days time is granted to him to file
his WS, if any.
At this stage, he submits that he has not received the
copy of the plaint and documents. Same be supplied to him within a
week under proper receipt and thereafter, WS be filed as per the
statutory period.
An application u/o 6 rule 17 CPC and u/o 1 rule 10
CPC filed by the plaintiff. Copy supplied to Ld. Counsel for the
defendant no. 1, 3 and 4. Same be also supplied to the defendant no.
2 under proper receipt.
Notice be issued to the proposed defendant on filing of
PF within 07 days from today, returnable on 05.02.2024.
Interim order to continue, till the next date of
hearing.
