Begumpur received with mention that statement of Jagpal Singh,
maternal grand father of accused Bitto Kumar, was recorded
wherein he stated that accused Bitto was residing with him at
address H-47, Rajeev Nagar Extn., Begumpur, Delhi.
Application has been filed by CLADC for
applicant/accused seeking waiver of condition of surety and
enlarging accused Bitto Kumar on personal bond on the premise
that he is unable to arrange for the surety and is languishing in
Jail.
On 26.05.2025 vide detailed order, applicant/accused
Bitto Kumar was admitted to bail on furnishing a personal bond
and a surety bond each in the sum of Rs.10,000/- in the backdrop
of the fact that the applicant/accused was not identified by the
aggrieved/victim in the organized Test Identification Parade and
even no robbed articles of victim were recovered from his
possession.

Applicant/accused has been unable to furnish the
surety.
In this fact of the matter, the condition of furnishing
surety bond of Rs.10,000/- as per order dated 26.05.2025 for
accused Bitto Kumari is waived and the applicant/accused Bitto
Kumar may be enlarged on bail by Superintendent Jail concerned
on furnishing a personal bond in the sum of Rs.10,000/- and the
said personal bond after execution be sent by the Superintendent
Jail to this Court.
Application of applicant/accused is disposed.
Copy of the order be given dasti.
Copy of the order be sent to concerned Superintendent
Jail for information and compliance.
