Sh. Rakesh Kumar Garg, Advocate and Ms. Mini
Verma, Advocate for accused Lakhan Verma submit that they are
not prepared for cross examination of the complainant/victim Sh.
Nikhil Chaudhary.
It was on 03.05.2025 when after framing of charge, the
case was fixed for today for examination of the complainant/ victim
Sh. Nikhil Chaudhary and on that day, Ms. Mini Verma, counsel for
accused Lakhan Verma was in attendance and in the knowledge of
the date of today for examination of the complainant/victim Sh.
Nikhil Chaudhary. In this fact of the matter, let PW1 Sh. Nikhil
Chaudhary be examined. It was the duty of the defence counsel to
prepare for examination of the material witness when they have
sufficient time of more than three and a half months period for

cross examination.
During the course of cross examination of PW1 Sh.
Nikhil Chaudhary by Sh. Ashish Dahiya, CLADC for accused
Sumit Kumar and Bittoo Kumar; Sh. Rakesh Kumar Garg and Ms.
Mini Verma, Advocates for accused Lakhan Verma left the Court
saying that they are not prepared for cross examination of PW1.
After the cross examination of PW1 Sh. Nikhil
Chaudhary by Sh. Ashish Dahiya, CLADC for accused Bittoo
Kumar and Sumit Kumar; and by Sh. Vikas Tomar, Advocate for
accused Anjali; when despite waiting for considerable time period,
the aforesaid privately engaged counsels for accused Lakhan Verma
did not return back for cross examination of PW1 Sh. Nikhil
Chaudhary till 12 Noon; accused Lakhan Verma submitted that for
want of the privately engaged counsel, he wants to avail the
services of Ld CLADC who is representing other two co-accused.
Accordingly, at request of the accused Lakhan Verma, Sh. Ashish
Dahiya is appointed as CLADC for accused Lakhan Verma also.
Sh. Ashish Dahiya, CLADC has cross examined PW1
Sh. Nikhil Chaudhary for accused Lakhan Verma. PW1 is
discharged after examination.
Fixed 18.11.2025 for remaining prosecution evidence.
PWs cited at serials Nos. 2, 4, 5 and 6 be summoned for
the next date of hearing.
IO and MHC(M) with case property, if any, be also
summoned.
