Written statement in respect of the defendants
except defendant no.2 and 6 filed on record on 21.10.2023
alongwith statement of truth.
It is perused that vide order dated 23.08.2023, date
of service of the appearing defendants is 05.08.2023. The written
statement has been filed beyond the stipulated period from the
date of service.
At this stage, Ld. counsel for the defendants (except
defendant no.2 and 6) prays for one opportunity to file an
appropriate application for seeking condonation of delay,
submitting that there were explainable circumstances for delay in
filing of written statement.
Ld. counsel for the plaintiff submits that he is not in
receipt of copy of written statement. He also seeks time to go

through the written statement once provided, to submit in respect
of necessity of defendant no.2 and 6 in the array of parties.
Let copy of written statement of the defendants
(except defendant no.2 and 6) be provided to the Ld. counsel for
the plaintiff within two days.
Let application, if any, for condonation as prayed be
filed within two weeks and also granted opportunity to the
appearing defendants to file requisite Affidavit of Admission/
Denial of documents of the plaintiff, with copy to be supplied to
the other side in advance.
Replication, if any, be also filed within the stipulated
period as per law, subject to consideration of condonation
application.
Put up for reply/Admission-Denial of documents
and consideration qua defendants nos.2 and 6 who are not
served, on 20.08.2024.
