An application under Section 114 read with order XLVII
Rule 1 and Section 151 CPC for review/recall of order dated
04.11.2025 was moved on behalf of defendant on 20.05.2026
alongwith an application under Section 5 of the Limitation Act for
condonation of delay in filing the review application.
It is pointed out by Ld.counsel for plaintiff that the
defendant has already challanged the impugned order dated
04.11.2025 before the Hon’ble High Court vide CM(M) No.1279/26.
This fact is also admitted by Ld.counsel for
applicant/defendant.
Ld.counsel for defendant has placed on record the copy
of order dated 29.05.2026 passed by Hon’ble Delhi High court in
CM(M) No.1279/26 with regard to the order dated 04.11.2025.
It is an admitted fact that the order dated 04.11.2025 has
already been challanged by the defendant before the Hon’ble High
Court. The Hon’ble High Court has been seized of the matter.
Therefore in view of provisions contained in Section 114 CPC, the
application for review of order dated 04.11.2025 is not maintainable
before this court. According the present applications under Section
114 read with order XLVII Rule 1 and Section 151 CPC for
review/recall of order dated 04.11.2025 and another application under
Section 5 of the Limitation Act for condonation of delay in filing the
review application moved on behalf of defendant are dismissed.
Be put up for arguments on the application under
Section 13A CPC on 23.11.2026.
