An application on behalf of plaintiff under the Code
of Civil Procedure, seeking substitution of the Authorized
Representative of the plaintiff is moved. Copy already supplied.
Arguments on the present application heard. Record
perused.
It is submitted by the Ld. counsel for the plaintiff
that the plaintiff was earlier represented through Mr.
Harshvardhan Garg, the then Authorized Representative.
However, he has now ceased to be associated with the plaintiff
company. It is submitted that plaintiff has now appointed Mr.
Praveen Soni as new AR to represent the plaintiff company. It is
prayed present application may kindly be allowed and Mr.
Praveen Soni be permitted to be substituted as AR of the plaintiff
company.
The present application moved by the plaintiff for
substitution of AR is supported with the letter of authorization
dated 30.01.2026 issued by the Director of the plaintiff company.

In view of the letter of authorization dated 30.01.2026, signed by
the Director of the plaintiff company. I am inclined to allow the
present application. Accordingly, Mr. Praveen Soni is allowed to
be substituted as AR of the plaintiff company. Application
disposed of accordingly.
It is also submitted by the Ld. counsel for the
plaintiff that defendant has failed to make the payment of the
previous cost of Rs.10,000/- imposed vide order dated
04.11.2025. It is also submitted that the written statement of the
defendant was taken on record subject to the payment of cost, but
cost not yet paid. That due to non payment of the cost, written
statement be not considered on record.
In view of the submissions regarding the cost, the
Ld. counsel for the defendant undertakes to pay the cost to the
plaintiff during the course of the day. The defendant is allowed to
pay the cost during the course of the day.
It is also pointed out by the Ld. counsel for the
plaintiff that the entire paper-book of the written statement and
other documents have not been supplied by the defendant despite
directions of the Court. On the other hand, it is submitted by the
Ld. counsel for the defendant that entire paper-book of the
written statement and the documents have already been supplied
to the earlier counsel for the plaintiff.
The perusal of the record reveals that the Ld.
Predecessor of this Court vide order dated 17.12.2024, directed

the defendant to supply the entire paper-book of the written
statement and copies of all the documents filed by the defendant
to the Ld. counsel for the plaintiff.
There is no endorsement in any of the proceedings
regarding supply of the copies to the plaintiff thereafter. Be that
as it may, without prejudice to the contentions of the parties, the
defendant is again directed to comply with the order dated
17.12.2024 positively on or before next date of hearing. The
entire paper-book of the written statement and copies of all the
documents in physical form be supplied to the Ld. counsel for the
plaintiff against receipt.
The plaintiff is directed to file the replication, as per
provisions of Commercial Courts Act on receipt of the cost and
the entire paper-book of the written statement and the documents,
supplied by the defendant.
