In the present matter, on the last date, R1 and R2 was
directed to file WS within 30 days. Last date was on 23.01.2025
but till date, no WS has been filed on behalf of R1 and R2. Today
none is present for R1 and R2. Perusal of record reveals that first
appearance on behalf of R1 and R2 was entered on on
19.10.2024 and since that date, no WS filed on behalf of R1 and
R2, accordingly, defence of R1 and R2 stands struck off.
Heard and record perused.
On the basis of pleadings of the parties, following issues
are being framed:
1. Whether on 16.01.2024 at about 9.00 pm, at Yamuna Express
way from Agra to Noida 110 KM, within the jurisdiction of PS
Raya, District Mathura, UP, one truck bearing registration No.
UP-83BT-3000 which was being driven in a rash and negligent
manner by its driver/R1 Sunil Kumar Singh, who had hit the car
bearing registration No. UP-78FT-9107 and thereby caused death
of victim Karandeep Singh? OPP
2. Whether petitioners are entitled to compensation, if so, to what
amount and from whom? OPP
3. Relief.
It is stated by ld. Counsel for petitioner that matter be
listed for Lok Adalat as there is possibility of settlement with
insurance company.
Be put up for settlement in lok adalat on 10.05.2025,
otherwise for PE on 17.07.2025.
