Present: Sh. R. P. Singh, Ld. Counsel for DHs with DHs.
Calculation sheet be filed.
Report of the Naib Nazir perused. No notice of the
appeal or stay on the execution petition has been received by the
court. The counsel for DHs has also stated that DHs have also
not received any notice of any appeal or any order passed staying
the execution of decree. The JD is having address situated within
the jurisdiction of this court as such, present execution petition
can be proceeded further by this court against him. It is stated that
no payment has been made by the JD for the satisfaction of the
decree. The DH is seeking assistance of the court for the
satisfaction of the decree by issuance of warrant of attachment
against the properties of the JD.
Considering the facts, where no payment have been
made for satisfaction of decree, let warrant of attachment be
issued against the properties of the JD as per the list filed by the
DH, on filing of PF and deposition of charges of beat of drums.
The copy of the order be also filed by the DH with the PF to be
attached with the warrants. PF be filed within 7 days from today.
The Civil Nazir will ensure execution of warrants as
per law and repeated efforts will be made by the Bailiff till
execution of warrants and if any objection is raised by the JD or
by anyone through JD then the Bailiff will take appropriate

remedy being public servant as per law and if the Bailiff
approaches Delhi Police seeking any action or help then, the SHO
concern will be under duty to take appropriate action upon the
complaint / request of the Bailiff made to him.
Warrants be put up before Ld. ACJ for appointment
of Bailiff for 22.04.2024.
Put up for report of Bailiff for 07.06.2024.
