Ld. Counsel for plaintiff has advanced arguments.
Ld. proxy counsels for defendant nos. 1 and 2 pray for
adjournment. They submit that Ld. main counsels for defendant nos. 1 and 2
are not available today.
Ld. Counsel for plaintiff has, during arguments, referred to a
demolition order passed by MCD. He submits that despite an order of
demolition having been passed, no action for demolition has place and the
illegal stucture is continuing at the premises, even though the demolition
order has not been challenged before any forum.
Nobody has appeared on behalf of MCD/defendant no. 3 to
explain the above.
That being so, let notice be issued to the Commissioner of MCD
with directions to disclose whether any action has been taken in pursuance to
the demolition order dated 16.05.2023. If so, relevant photographs of the site
taken after the said demolition shall be placed on record. Copy of this order
shall be sent with notice.
Renotify on 01.06.2026. Short date is given in view of pendency
of application for interim relief.
