Counsel for R2 that with R2, offending vehicle is insured only for own damage cover and there is no third party insurance company with R2. Accordingly, application u/o 1 Rule 10 CPC filed on behalf of R2. Alongwith the application, copy fo insurance policy also placed on record which has also been filed by the petitioner depicting that offending vehicle is insured with R2 only qua own damage cover. Accordingly, the application stands allowed and R2 is deleted from the array of the parties. Perusal of policy document reveals that package policy covering the period of accident is with Bajaj Allianz General Insurance Co. Ltd. Petitioner is directed to take steps for impleadment of concerned insurance policy qua which the offending vehicle is covered for third party liability. Fresh vakalatnama filed on behalf of R1. Time sought on behalf of R1 for filing of WS. One week’s time is granted to R1 to file WS and for filing of insurance policy of offending vehicle qua third party liability.
