Sh. Tejpal Singh, Ld. Counsel for the defendant no. 2 with
defendant no. 2.
Defendant no. 1 in person.
On the LDOH, the plaintiff filed the application for
summons for judgment. However, the summons have not been issued as
the steps not taken by the plaintiff. However, Ld. Counsel for the
defendant no. 2 submits that on the last date i.e. 30.09.2024, he was
supplied with the copy of the application for summons for judgment. He
submits that he has already filed the application for leave to defend
along with application for condonation of delay on 11.10.2024 through
online mode with copy to the plaintiff and the hardcopy is filed today.
It is submitted by Ld. Counsel for the plaintiff that he has
not received the copy earlier and the same is supplied to him only today.
As the application is already filed on 11.10.2024, there is a
delay of only 01 day in the filing of the application. Hence, the
application for condonation of delay is allowed.

On the LDOH, the defendant no. 1 was not present. There is
no such endorsement in the case file that he has received the summons
for judgment.
Issue summons for judgment to the defendant no. 1. As the
defendant no. 1 is present in the court, he has accepted the summons.
Put up for reply/ arguments on the application for leave to
defend on 21.04.2025. Advance copy of the same be supplied to the
opposite party atleast 15 days prior to the next date of hearing.
