Replication is filed by the plaintiff to the W/S filed
by the defendants alongwith certain documents with the list of
documents. Copy supplied.
It is submitted by the Ld. Counsel for the defendants
that an application U/O 7 R 11 CPC is pending disposal.
Pleadings are stated to be complete. On the basis of
the pleadings, following issues are framed:
1. Whether the plaintiff has not approached the court with
clean hands, if so, its effects? OPDs
2. Whether the suit is without cause of action and is liable to be
rejected U/O 7 R 11 CPC? OPDs
3. Whether the plaintiff is entitled to a decree of permanent
injunction against the defendants, as prayed for? OPP
4. Whether the plaintiff is entitled to a decree of declaration
against the defendants, as prayed for? OPP
5. Relief.
No other issue has been raised or pressed for by the parties.
List of witness be filed by the parties within 15 days
with advance copy to opposite side.
