In the present matter though service already effected on R1
and R2 and vakalatnama filed on behalf of R1 and R2 on
13.10.2023 but till date no WS has been filed on behalf of R1 and
R2. Since statutory period for filing of WS has been elapsed.
Therefore, defence of R1 and R2 stands struck off.
Heard and record perused.
On the basis of pleadings of the parties, following issues
are being framed:
1. Whether on 19.07.2022 at about 5:00 am, at Chaar Murti to
Prathla within the jurisdiction of PS Sector 113, Gautam Budh
Nagar, UP, one Eicher Tractor bearing registration No. UP 37R-
8286 which was being driven in a rash and negligent manner by
its driver/R1 Darshan Yadav had hit motorcycle bearing
registration No. UP14DN 5372 and thereby caused injuries to
petitioner Bhim Sen? OPP
2. Whether petitioner is entitled to compensation, if so, to what
amount and from whom? OPP
3. Relief.
Be put up for PE for 03.09.2024.
Petitioner is directed to give advance copy of the affidavit
of witness to respondents one month prior to the next date of
hearing.
Petitioner may also take steps to summon the witness, if so
required, expeditiously.
