It is a settled law that procedure is hand maid of justice and
it is also settled law that procedural technicalities should not prevent
substantive justice. Therefore, if a procedural violation does not
prejudice the other party, the Court my take a lenient view and Court
should allow applications for placing on record additional documents if
the documents are necessary for just and fair disposal of the case.
In the case titled Levaku Pedda Reddamma Vs.
Gottumukkala Venkata Subbamma 2022 LiveLaw (SC) 533, Hon'ble
Apex Court observed that refusing permission to a party in a civil suit to
produce additional documents even if there is delay will lead to denial
of justice. In such cases, the trial Court can impose some cost rather than
to decline the production of document itself.
