Further, two weeks’ time sought on behalf of the Defendant to file reply to application under Order XXXIX Rule 1 and 2 CPC. Heard. Allowed. At this stage, Ld. Counsel for plaintiff presses his application under Order XXXIX Rule 1 and 2 CPC. It is submitted by Ld. Counsel for plaintiff that he is in settled possession of suit property since 1940s and Defendants are making efforts to dispossess the Plaintiff and if the Defendant succeeds, the suit of plaintiff will become infructuous. Per contra, it is submitted by Ld. Counsel for Defendant that Defendants are in possession of suit property and also placed on record certain NBT challans to show his possession. However, at this stage, it cannot be ascertained as to who is in the possession of suit property without listening to arguments on application under Order XXXIX Rule 1 and 2 CPC at length. In order to avoid any further controversy between the parties over the suit property, both parties are directed to maintain status quo till NDOH.
