Perusal of record shows that DH has not complied with
the previous orders. Also, cost imposed vide previous order has not
been paid.
Perusal of the record shows that notice was issued to the
JD vide order dated 05.12.2024 and DH was directed to file PF
within 15 days. No PF was filed and another opportunity to file PF
within ten days was granted vide order dated 22.03.2023. Another
opportunity was granted to file PF within 15 days on the next date of

hearing i.e. 17.07.2025. Yet another opportunity was granted to file
PF subject to cost within ten days vide order dated 12.05.2026. Till
date no PF has been filed in compliance of order dated 12.05.2026.
None is present to explain the circumstances for non
filing of PF.
It appears that DH is not interested in pursuing the
present execution petition.
In view of the same, present execution petition is
dismissed-in-default and for non-prosecution.
File be consigned to record room after due compliance.
