Submissions heard.
It is stated by Ld. Counsel for defendant that
some time is required to file report in the present case and as
per his instruction the plaintiff had no legal right to continue
in the property and the suit is not maintainable.
The plaintiff has asserted that the plaintiff has
been in possession of the suit property for more than 20 years
and electricity connection was also installed at the same
premises. Copy of electricity connection is annexed which
shows the energisation date as 19.09.2022.
Accordingly, summons be issued against the
defendant on filing of PF.
Notice of the suit is accepted on behalf of
defendant no.1. Let reply to the application U/o 39 rule 1 and
2 CPC and WS be filed within 30 days from today with
advance copy to the opposite party.
It is stated by Ld. Counsel for defendant no.1
that as per his instructions the demolition action has been
completed and only an iron garter has been left in some
portion which was not removed as the same could have
resulted in demolition of some others property. However, it
is stated that the suit property pertain to DUSIB and plaintiff
has no locus to maintain the suit.

Ld. Counsel for plaintiff has prayed that the
defendant no.1 be directed not to take any further demolition
action in the suit property i.e. Jhuggi No.85, H-2,
Jahangirpuri, Delhi.
Considering the aforesaid submissions, the
defendant no.1 is hereby directed not to take any demolition
action qua the suit property any further till NDOH.
